Texas sues Biden administration over abortion executive order

(KYMA, KECY/ CNN) - The state of Texas is challenging an executive order President Joe Biden signed last week that forbids health care providers from denying abortions in certain situations.

The Department of Health and Human Services issued new guidance Monday based on that order.

It says state laws can not forbid abortions in medical emergencies.

The federal government has the authority to revoke Medicare and Medicaid funding from institutions that violate that order.

Texas is arguing the 'Emergency Medical Treatment and Labor Act' does not allow the federal government to force providers to perform abortions.

The suit claims the new guidance forces hospitals to decide between violating state law -- or potentially lose federal reimbursement.
