Yuma car crash suspects hear charges against them
After crashing into a home and liquor store, the alleged suspects appear in Yuma County Superior Court
YUMA, Ariz. (KYMA, KECY) - 28-year-old Guadalupe Pelayo accused of crashing into a Yuma home with seven people inside, nearly missing children Tuesday night is charged with eight felony counts and one misdemeanor.
Judge Gregory Stewart with the Yuma County Superior Court stated the charges Pelayo is facing.
"Count one being criminal damage, a class four felony. Counts two, three, four, five, fix, seven, and eight alleged endangerment. Those offenses being listed as class six felonies," said Stewart. "And count nine alleges reckless driving, a class two misdemeanor."
Pelayo is not in custody and his preliminary hearing is set for August 8.
There are certain restrictions he must follow.
"That you not threaten or initiate with any alleged victim, that you not drive a motor vehicle without a valid driver's license and not go to the scene of the alleged crime," explainsedJudge Stewart.
The 19-year-old woman who crashed into EZ Shop Market on Fourth Ave. and 13th St. has no charges filed against her at this time.
Though the county attorney's office did submit a follow-up request.
"So there must be some additional information that they're requesting from the arresting officer before they make a determination as to whether or not charges would be brought against you in this case," said Stewart.
Judge Stewart stated she is not a flight risk, so she will remain out of custody.
She is to return to adult probation to notify the pre-trial service officer that no charges have been filed, pending review of the county attorney's office.
