Arizona attorney general leads coalition challenging Biden admin’s tax mandate
Released statment deems it "unconstitutional"
PHOENIX, Ariz. (KYMA, KECY) - Attorney General Mark Brnovich has just led a coalition of 20 states supporting Ohio's lawsuit which challenges the Biden Administration's Tax Mandate in the American Rescue Plan Act (ARPA). His office called the taxing "unconstitutional."
ARPA threatens to keep COVID-19 relief funding from states if they lower taxes by any degree. States violating the provision would have to repay fees to the U.S. Department of Treasury (Treasury).
“States must stand together and push back against this assault on state sovereignty,” he shared. “I am proud to lead this coalition and fight for hardworking taxpayers across the country.”
The 20-state coalition urges the Sixth Circuit Court of Appeals to uphold an injunction banning the federal government from enforcing the Tax Mandate against Ohio. Collectively, the states argue Ohio has every right to sue because of the impact ARPA has had on Ohio's economy.
According to the brief released, the coalition of states also argues the Tax Mandate is ambiguous and unconstitutionally puts states in a bind, having to decide what's more important to them: constitutional rights or government handouts.
Alabama, Alaska, Arkansas, Florida, Idaho, Kansas, Kentucky, Louisiana, Mississippi, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah and West Virginia have joined the attorney general.
