University of Chicago second rape allegation

CHICAGO (CBS, KYMA) - There is a case alleging a rape at a fraternity party inside the Alpha Delta Phi House on the University of Chicago campus.

Police have not charged anyone in this particular case, but the Jane Doe is hoping the civil suit filed Wednesday will lead to criminal charges.

The Alpha Delta Phi fraternity, now the second fraternity house at the University of Chicago, is under scrutiny for an alleged sexual assault at a party on their property.

A civil suit filed Tuesday by a woman known only as Jane Doe details the accusations in explicit detail.

"He offered her what she understood to be some kind of a shot. Encouraged her to drink it and then after she consumed it immediately started to feel that something was wrong," said one woman.

Doe and her attorneys named the alleged attacker, a student at the university, Kevin Shim. Doe said Shim coerced her onto the second floor into a bedroom despite her being unsteady and lightheaded.

"She increasingly started to lose awareness of what was going on," the woman explained.

The suit describes Doe as mentally and physically incapable of providing consent. Despite that, Doe said Shim refused to use contraception and raped her.

"Her friend realized that she was not with her at some point at the fraternity house and somehow found out that her friend was upstairs," the woman said.

The lawsuit alleges other members of the fraternity blocked that friend from reaching Doe. The friend eventually got through.

"She found her friend unconscious in the bedroom where she was assaulted," the woman detailed.

This case filed as Greek life faces scrutiny nationwide. Last week, a CBS News affiliate in Chicago talked about more allegations of sexual assault at the AE Pi house a few blocks away.

The suit coming out of Cornell University in New York propelled this Jane Doe to speak up.

"She is working through this. A sexual assault like she experienced alters a person in ways that unless you've gone through it yourself personally you can never imagine," the woman said.

Alpha Delta Phi said they suspended the member from their fraternity after they learned about these allegations.

Police said they are still investigating, going through evidence, as well as likely the rape kit that Jane Doe completed the day after this alleged attack.

The CBS affiliate in Chicago did try to reach Shim. No response from him.
