Family sues Southern California fitness club after toddler suffers brain injury

EL SEGUNDO, Calif. (NBC, KYMA) - A family is suing a fitness club in Southern California after they say their child was seriously injured after he was dropped at the gym's daycare.

Video provided in a lawsuit shows a daycare worker at the Bay Club ClubHouse in El Segundo throw a child in the air. Then, the child smashed his head on the hardwood floor and the worker lands on top of him.

Now, the child's parents are suing the Bay Club for negligence.

The lawsuit says the child "suffered a traumatic brain injury" when he hit the floor after he was tossed approximately six feet "above the ground."

The lawsuit says the Bay Club lied to the parents about the severity of his injury and how it happened.

Initially, the suit says the Club gave the dad the impression that his son only sustained a minor injury.

The family's attorney released the following statement:

"The deception by the Bay Club of hiding this horrific incident from the parents is inexcusable. The day care facility should have the highest amount of care for the children, and if a child gets sick or injured, they should notify the parents with transparency and urgency."

However, the Bay Club, which operates more than 25 clubs primarily in California, responded to the lawsuit saying, "We are unable to comment on ongoing litigation. At the Bay Club, the safety of our members, team members, and the families we serve is our highest priority."

Parents outside the gym shared their reaction to the case.

"It's sad. It's very sad especially a toddler. They don't really have much of a voice so it's pretty concerning as a parent," said Anna Orozco, a parent.

The family, their attorneys and representatives for Bay Club did not make themselves available for an on-camera interview with NBC affiliate KNBC.

While the family did not say how much money they're seeking, they are demanding a jury trial.
