Governor Newsom files lawsuit over recall filing mistake

(KYMA, KECY/ CNN) - California Governor Gavin Newsom is suing his own Secretary of State to have his party affiliation listed on the state's upcoming recall election ballot.

The Democratic Governor says his election attorney accidentally left off his party affiliation in filing last year.

The lawsuit says Newsom filed a new notice with the Secretary of State's office this month correcting the mistake, but it was denied.

A spokesperson for Shirley Weber says accepting a filing after a deadline would require a judicial resolution. The lawsuit seeks to force Weber to print Newsom's party preference on the ballots.

The date for the recall election has not yet been sent.
