TUCSON, Ariz. (KYMA, KECY) - A 54-year-old man was arrested on one count of assault on a federal officer with the use of a deadly weapon and was charged by criminal complaint.

According to the U.S. Attorney's Office District of Arizona, a U.S. Border Patrol agent attempted to do an immigration inspection on Daniel Jerome Wagner's vehicle who was suspected of smuggling undocumented individuals.

The agent followed Wagner's vehicle that was speeding westbound on U.S. State Route 80, Wagner then stopped driving which caused the vehicle to spin in the middle of the highway.

The agent stopped driving and saw Wagner driving eastbound towards the agent's marked U.S. Border Patrol vehicle, Wagner then crossed into the agent's lane that forced the agent to drive off the highway and onto the shoulder to avoid being hit.

Wagner then drove past the agent's vehicle, barely missing him and other agents followed Wagner and were able to arrest him.
