Trick-or-treaters over the age of 12 could be jailed in Virginia

Virginia is keeping the mischievous part of trick-or-treating to a minimum by enforcing jail time for those over the age of 12 on Halloween.

The city of Chesapeake has an ordinance code that states if anyone over 12 years of age participates in “trick or treat” or any similar activity, “he or she shall be guilty of a misdemeanor and shall be punished by a fine of not less than $25 nor more than $100 or by confinement in jail for not more than six months or both.”

The city won’t be seeking for violations, but there is a strict schedule set for Halloween stating anyone trick-or-treating after 8 p.m. will be guilty of a misdemeanor and punished.

The code clearly states that “If any person shall engage in the activity commonly known as “trick or treat” or any other activity of similar character or nature under any name whatsoever after 8:00 p.m., he or she shall be guilty of a misdemeanor and shall be punished by a fine of not less than $10 nor more than $100 or by confinement in jail for not more than 30 days or both.”

However, the code does state that parents are allowed to accompany children under the age of 12 without penalty.
