Lindsay Clancy retrial: What happens next

PLYMOUTH, Mass. (CBS, KYMA) - The high-profile murder trial against Massachusetts mom Lindsay Clancy is finally over, but there are still big questions about what happens next.

Last week, the judge in the case declared a mistrial after the jury was unable to reach a verdict.

Clancy's defense team petitioned the state supreme court to intervene with no luck. They argue clancy was over-medicated and experiencing postpartum psychosis when she killed her three children back in January of 2023.

Prosecutors maintain she acted intentionally and should be held criminally responsible.

Legal experts, like Caroline Polisi, said assembling another jury for a possible retrial could be challenging.

"Just how much it captured the nation, it's going to be extremely difficult. They'll have to do a really really intensive what we call a voir dire process meant to weed out stealth," Polisi explained. "You don't want one person going in there, lying during voir dire and then getting in there going one way or the other."

Clancy remains at the psychiatric hospital where she's been held since 2023, and a status hearing to determine next steps in the case is set for later this month.
