Lawyer files a lawsuit over Biden’s Student Loan Forgiveness Plan
(KYMA, KECY/CNN) - A lawyer filed a lawsuit over President Biden's student loan forgiveness plan, arguing the policy is an abuse of executive power.
Frank Garrison claims because of the forthcoming student loan forgiveness, he will be forced to pay state taxes on the amount canceled, an expense he would otherwise avoid.
The lawsuit is backed by his employer, a non-profit law firm.
Under Biden's plan, borrowers, under certain income levels, will see up to $10,000 of their Federal Student Loan debt forgiven.
If a borrower also received a Federal Pell Grant while in college, then they are eligible for up to $20,000 of debt forgiveness.
In addition, Borrowers will not have to pay federal income tax once the student loan debt has been forgiven.
But, there are a handful of states that may tax discharged debt if changes are not made.
