Judge sides with Izak Lucero’s defense over legal battle involving witnesses

YUMA, Ariz. (KYMA, KECY) - A legal battle consumed the Izak Lucero murder trialĀ and the judge is letting the defense bring in two more witnesses.

The state has rested its case and now the defense will be allowed to bring forth a witness the state says was not disclosed before the trial.

Inmate German Hernandez testified against Lucero last week in court saying he confessed to the crime.

The defense says it pulled an investigator who went to the jail to verify his credibility, saying there have been talks hernandez went back and 'bragged' about his testimony.

The state says the investigator should not be able to testify because they have not seen the evidence or had a chance to interview him.

"I'm going to allow these witnesses, so, I mean, how are we going to deal with it? I'm going to allow this information to come in. I'm going to allow the investigator to testify," said Judge Roger Nelson. "Do you want a chance to interview him?"

"Absolutely, we been requesting that since the beginning of April," Prosecutor Meaghan Gallagher exclaimed.

Aside from the investigator, the defense also wants to bring forward another inmate who they claim has some information to share.

The trial resumes Friday.
