Gov. Ducey redefines ‘Brady list’ for law enforcement
Reaches out to Secretary of State about signing bill
PHOENIX, Ariz. (KYMA, KECY) - Governor Doug Ducey took the time Friday afternoon to write a letter to Arizona Secretary of State Katie Hobbs. He discussed his recent signing of House Bill 2295.
HB 2295 reestablished standards for reporting and maintaining the Rule 15.1 database lists, commonly referred to as the "Brady list."
The Rule 15.1 Disclosure Database is intended to be used only by participants within Arizona’s criminal justice system for purposes of complying with the State’s disclosure obligations under Rule 15.1, Ariz.R.Crim.P., Brady v. Maryland, 373 U.S. 83 (1963), and its progeny.
The bill systematically defines the formal process in which law enforcement is put on the list, by providing fairness and transparency to the officer prior to being added to the list. It also allows an officer to request reconsideration if he/she believes their name should not be included in the "Brady list."
"This is an important step to continue fostering responsible and respectful law enforcement officers by ensuring good officers are not unfairly punished," shared Gov. Ducey. "...while not tying the hands of law enforcement officials."
Additionally, the bill guarantees that officers whom have had performance or legal issues, continue to be held accountable. Law enforcement agencies will still have access to all disciplinary records to make informed decisions when hiring.
