Former FBI Director James Comey attempts to his case thrown out

(CNN, KYMA) - Former FBI Director James Comey is trying to get the federal criminal case against him dismissed.

The Justice Department has accused Comey of lying to Congress and obstructing justice.

On Monday, Comey's lawyers filed motions asking the court to dismiss the case. The lawyers argue Comey is being singled out for prosecution because of his criticism of President Donald Trump.

Comey's lawyers also said the case against their client is illegitimate because the president illegally appointed an interim U.S. attorney to prosecute the case.

Comey has denied any wrongdoing.

The Justice Department is trying to get Comey's lead attorney thrown off the case.

Prosecutors accuse Patrick Fitzgerald of having a conflict of interest. They say Comey shared classified material with Fitzgerald in 2017.

Fitzgerald says the accusation is false.
