ICE officer shoots man in Austin, Texas

AUSTIN, TX. (NBC, KYMA) - An ICE officer shot and seriously wounded a Venezuelan man Sunday afternoon in Austin, Texas.

The 28-year-old man, identified by an attorney as Wilber Rafael Garces Perez, was shot in the torso around 1 p.m. and was taken to the hospital in serious but stable condition.

He has since been released from the hospital and he's believed to now be in ice custody.

A law enforcement source told NBC news that the man, who lives in Austin with his wife, is in the U.S. illegally and was also given a final order of removal.

The Department of Homeland Security has not, however, provided information about whether the ICE agents involved were wearing body cameras.

Or if the man who was shot was the target of the operation or if they have any criminal background other than an immigration violation.

The White House referred NBC news to the DHS for comment, a DHS spokesperson said they will look into it.

Protesters gathered at the site of the shooting expressing their concern over the incident as police officers and ICE agents taped off the area.

City officials held a press conference later in the afternoon to provide the public with what information they had.

Austin police chief Lisa Davis said there was a small foot pursuit before the shooting.

Although the mayor said the Austin Police Department was not involved in the shooting, their investigators were on the scene to assist.

Mayor Kirk Watson said he asked for the city of Austin to be involved in the investigation going forward.

This comes two months after another ice officer fatally shot Lorenzo Salgado Araujo in Houston during an attempted traffic stop.

Araujo was a Mexican national, the DHS said he was in the country illegally and tried to run over agents with his car.
