Analyzing the likelihood of success with Kari Lake lawsuit
Phoenix, AZ- Kari Lake scored a small victory as two out of the ten election fraud counts get their day in court, with a deadline on the judge's decision coming early next week.
The question is, while Lake cleared her first hurdle, how much of a chance does her lawsuit actually have? The burden is on her is to prove, not just that there was fraud, but that the fraud resulted in the loss of enough specific Kari Lake votes where the "valid" election results would make her the winner.
That argument was last tried in 2000 and while even that wasn't successful, it did make it to the supreme court. However, the difference was tangible. You may recall the famous hanging chad fiasco. That's when Florida voters say they intended to vote for Al Gore, but due to the format of the ballot, they accidentally voted for Reform Party candidate Pat Buchanan. Lake has to prove something similar.
KYMA spoke with legal expert William Bell to get his take on the case.
"In 2000, a person indented to vote for Al Gore but they actually voted for Buchanan. There was granular evidence there was intentionality there. Here so far with Lake, you just have assertions. She's just saying individuals were fiddling with printers, she's just saying people weren't watching the ballots when they should have. The level of granularity, which is required, just isn't there in this instance."
