Biden Administration appealing Title 42 decision

Adam Klepp

(KYMA, KECY) - As of this afternoon, the Biden Administration has filed an appeal against a court decision that set an end date on Title 42.

Title 42 allows U.S. authorities to rapidly expel migrants caught at the border to Mexico without the chance to pursue asylum.

The policy primarily deported Mexican, Guatemalan, Honduran, and recently Venezuelan migrants.

The judge who struck down the public health policy sided with the ACLU in a lawsuit arguing Title 42 places migrants in harm's way and violates U.S. asylum law.

However, Title 42 is still scheduled to end on December 21.

As the Biden Administration is not seeking an emergency stay.

We will continue to follow this developing story.
