BOSTON (WCVB) — A man who attempted to dive out a 12th-floor window of a high-rise apartment building in Boston after a body was found in the building is now facing upgraded charges.

Michael Perry, 37, will be arraigned on a murder charge Friday. Earlier this week. He was arraigned on a charge of assault with a dangerous weapon and held pending a dangerousness hearing.

Police were called to the 29-story residential and commercial building at 35 Northampton St. at 2 a.m. Monday.

Officials said officers knocked several times and did not receive a response from the apartment. When they gained entry, they found the body of Jose Aponte, 43.

“When police got there, they found the resident of the apartment deceased in the apartment with significant signs of physical trauma. Mr. Perry was farther back in the apartment. He had moved things to obscure himself. They called out to him, asked him if he had any weapons, and his response was ‘Come and find out,'” a prosecutor said during Perry’s arraignment.

They said they also made contact with a second person who was inside, and a standoff was declared. Police said SWAT officers who entered the apartment “were met with a physical threat.”

“At that point, he dropped the weapons. He then jumped out the window,” said Assistant District Attorney Ian Polumbaum.

According to the police report, “… the suspect was hanging upside down, outside of the window, being held on by only his underwear, which was caught on the window handle.”

Officers quickly propped open the window to hold onto his legs while other officers ran down to the 11th floor and smashed out that window to pull Perry in to safety.

The incident started with a call for a well-being check on the person Perry went to visit on Friday.

“When the police got there, they found the resident of the apartment deceased in the apartment, with significant signs of physical trauma,” Polumbaum said.

The charge of assault with a dangerous weapon was in relation to an alleged assault on a police officer and not connected with Aponte’s death.

Perry has a history of violent incidents in the city, including one where he jumped out a window when police were trying to arrest him, 5 Investigates has learned.
