Econo Lodge murder trial declared a mistrial, jury unable to reach verdict
Jury deadlocked on all of the charges, potential retrial coming
YUMA, Ariz. (KYMA, KECY) - After nearly one month of arguments from the state and defense, the murder trial against Izak Lucero ended in a mistrial after the jury could not come to a proper verdict.
25-year-old Izak Lucero will instead remain in custody, unconvicted.
Superior Court Judge Roger Nelson declared the mistrial after receiving a note from the jury saying they could not come to an agreement on the charges - also known as a "deadlock."
The only way to get a "guilty" or "not guilty" verdict would be a unanimous decision amongst all 12 jurors-- that did not happen.
The trial began April 5th and the jury deliberated for less than a day after the closing arguments.
Lucero was facing second-degree murder charges in the death of 21-year-old Luis Delgadillo, who was shot multiple times nearly two years ago at the Econo Lodge Motel in Yuma.
One of the decisions the jury was contemplating was also first-degree premeditated murder.
The decision between first and second-degree murder also on top of several other charges including aggravated assault with a deadly weapon and drug charges.
Due to the mistrial, Lucero will appear back in court for a trial setting in early May as the state will have the chance to retry the case. That's something state prosecutor, Meaghan Gallagher, stated they intend to do.
Lucero remains in custody on a $500,000 cash-only bond.
If retried, a new jury will be selected.
