Man who illegally entered U.S. has prior criminal history

Tucson Sector Border Patrol agents arrested a 42-year-old Guatemalan man Thursday, near Sells, and later learned he was previously removed from the United States following a conviction for sex with a minor.

Agents arrested Miguel Chapeton for illegally entering the U.S. and, during processing, found he was convicted in 1994 in Suffolk County, New York for sex crimes against a child.

Chapeton is being prosecuted for felony immigration charges for re-entering the U.S following deportation.

Federal law allows agents to charge individuals by complaint, a method that allows the filing of charges for criminal activity without inferring guilt. An individual is presumed innocent unless and until competent evidence is presented to a jury that establishes guilt beyond a reasonable doubt.
