Kilmar Abrego Garcia taken back into ICE custody
UPDATE (1:09 PM): A judge has ordered Kilmar Abrego Garcia must stay in the United States for now.
The Maryland federal judge issued an order saying Abrego Garcia should be given proper due process to fight his potential deportation.
This comes after Abrego Garcia was taken into ICE custody Monday morning.
The Maryland construction worker was mistakenly deported to a notorious prison in El Salvador in March.
He was returned to the U.S. in June to face human smuggling charges.
He reunited with his family last week after his release from federal custody on parole Friday.
According to his lawyer, Abrego Garcia was taken into ICE custody after an immigration check-in that was part of his parole.
His attorneys say the government's actions are an overreach.
The Trump Administration announced over the weekend its intention to deport him to Uganda. They allege the 30-year-old married father is a danger to the community and an MS-13 gang member.
Abrego Garcia denies the gang allegation, pleaded not guilty to smuggling charges, and has asked a judge to dismiss the case on ground of vindictive prosecution.
BALTIMORE (CNN, KYMA/KECY) - Wrongly deported Maryland resident Kilmar Abrego Garcia is back in U.S. custody.
He reported to an Immigration and Customs Enforcement (ICE) facility in Baltimore Monday morning.
Abrego Garcia was just released from custody in Tennessee Friday after being illegally deported to El Salvador in March and spending months in a notorious Salvadoran mega-prison.
Abrego Garcia now faces federal human smuggling charges, and the Trump administration is threatening to once again deport him.
Before walking into the ICE facility, Abrego Garcia spoke to a crowd of his supporters outside.
"Brothers and sisters, my name is Kilmar Abrego Garcia, and I want you to remember this...remember that I am free and I was able to be reunited with my family," he said.
Abrego Garcia's lawyers say the government is trying to punish their client for challenging the wrongful deportation earlier this year.
Meantime, the government has offered a plea deal which could result in his deportation to Costa Rica. The plea deal offer reportedly expires Monday morning.
Homeland Security Secretary Kristi Noem posted on social media saying Abrego Garcia is being processed for deportation.
A notice last Friday said the administration might attempt to deport him to Uganda.
